CCS Extraordinary Pension Rules 2023: Conditions for awarding a disability pension or family pension

Rule: 4. Conditions for awarding a disability pension or family pension.-(1) Disability pension or family pension will be awarded under these rules if there is a causal connection between,-

a) civil servant disability and civil service; or

b) death of civil servant and government service.

(2) Disability is considered to be caused by the state administration if it is proven that it is caused an injury, injury or illness which,-

a) attributable to civil service; or

b) existed before government service or arose in the course of it and thus worsened.

(3) A death shall be deemed to have been caused by public service if it is proved that it was caused or

hurried, -

(a) an injury, injury or illness attributable to public service; or

(b) aggravation of an injury, injury or illness which existed before the Government or arose during the Government and such deterioration is attributable to government service.

(4) A state employee or family does not have to submit an application for a grant disability pension or family pension under these rules.

(5) The responsibility of the head of the office is to assess each case of death or disability as a result of an accident or disease caused to a Government servant based on the findings of the Medical Board and take necessary action submit the case to the competent authority within three months from the date of receipt of the doctor's report council, for a decision on granting a disability pension or a family pension according to the following rules:

Provided that an application for invalidity pension or survivor's pension under these rules shall not be refused on the day taking into account any delay by the lead office in submitting the case to the competent authority for a decision on awarding a disability pension or a family pension according to this regulation.

(6) The disability pension consists of a severance pay and a disability pension, which are determined in

in accordance with Rule 10 of these Rules.

(7) Upon the death of a pensioner who received a disability pension, the family pension belongs to

in accordance with sub-rule (2) of rule 11 of these rules.
