Sir,
I am directed to refer your email dated 21. 03.2022 addressed to Hon'ble President and Honourable Supreme Court on the subject mentioned above. A copy of same has been received in this office.
2. vide aforesaid said email, it appear that you have raised the issue related to the judgement dated 16.0302022 given by the Honorable Supreme Court in WP (civil) number 419 of 2016 on the OROP issue and requested to recall and set aside the set judgement in the matter.
3. Hon'ble Supreme Court wide its judgement dated 16.0302022 has found no constitutional infirmity in the OROP principal as defined by the communication dated 7th November 2015. However in respect of refixation of pension under OROP Hon'ble Supreme Court has directed the government to carry out fixation exercise from 01st July 2019 upon expiry of 5 years and two compute arrears to all eligible pensioners of the Armed Forces and pay within a period of 3 months. As per direction of Hon'ble Supreme Court the matter related to second revision of pension is under process in this department.
