UPS Rules 2026: Once You Take NPS Benefits, There's No Going Back to Unified Pension Scheme
What central government employees — especially railway staff — need to know before making their pension choice
The Railway Board has issued a significant clarification that settles one of the most debated questions since the Unified Pension Scheme (UPS) was launched: Can an employee switch to UPS after already receiving retirement benefits under NPS?
The answer, according to Railway Board Order RBE No. 48/2026, is a firm No.
What Triggered This Clarification?
Several railway zones were facing confusion over a specific scenario: employees who retired after April 1, 2025, did not opt for UPS at the time of retirement, received their full NPS retirement settlement (Final Exit), and then tried to apply for UPS within the deadline of November 30, 2025. In some cases, technical errors (online portal issues) prevented DDOs from processing these applications.
The Railway Board sought guidance from PFRDA (Pension Fund Regulatory and Development Authority) on whether exceptions could be made. PFRDA's response was unambiguous.
What PFRDA Said
Under the UPS Regulations, 2025, the option to switch to UPS is available only to specific categories of employees:

What About the Spouse?
This is perhaps the most impactful part of the order. If an employee:
- Retired under NPS after April 1, 2025,
- Withdrew all NPS retirement benefits (Final Exit),
- And subsequently passed away,
…then even the surviving spouse cannot claim UPS family pension. They will only receive benefits as per the Annuity Plan the employee had chosen under NPS.
Why November 30, 2025 Still Matters
PFRDA had set November 30, 2025, as the last date for eligible employees to opt into UPS. However, meeting this deadline alone is not enough — eligibility must also be met. Employees who had already settled their NPS accounts before applying are not eligible, regardless of timing.
